Terms of Sale

How pricing actually works here, what a quote commits us to, and where the risk sits.

Last updated

These terms govern every sale made through this site. Placing an order, requesting a quote or opening a wholesale account means you accept them.

1. Who you are buying from

The seller is Tokyo Legends Trading Co.(“Tokyo Legends”, “we”), trading as Tokyo Legends. We source authentic Japanese Pokémon sealed product in Japan and sell it to business buyers in the United States. Reach us at tokyolegends@outlook.com.

Pending — entity detailsThe registered address and the jurisdiction of formation of Tokyo Legends Trading Co. are not yet published here. Request them by email and we will supply them in writing before you place an order.

2. This is a wholesale channel

The site sells sealed booster boxes for resale, not single cards to collectors. By ordering you confirm that you are buying in the course of a business — a card shop, a breaker or streamer, or a reseller — and not as a consumer. We may ask for a resale certificate number before accepting an order, and we may decline any order where we are not satisfied of this.

3. Pricing

Read this section carefully, because our model runs the opposite way to most wholesale price lists.

The published price list is a FLOOR, not a starting point. The top tier pays exactly the list price. Every other combination of account tier and quantity pays that price plus a surcharge. Nothing on this site is ever sold below list, and we do not offer discounts.

3.1 Account tier surcharge

Every box carries a per-box surcharge determined by the tier on your approved wholesale account:

  • Gold no surcharge; you pay the list price itself.
  • Silver $5.00 added per box.
  • Standard $10.00 added per box.
  • No approved account — a visitor buying without a wholesale account is charged the Standard surcharge of $10.00 per box.

Tiers buy priority access to allocation and account perks. They do not buy a lower price than the list, because there is no price lower than the list.

3.2 Under-minimum surcharge

Each SKU has a minimum order quantity printed on its product page. Boxes bought below that minimum carry a further $30.00 per box. At or above the minimum the surcharge does not apply.

3.3 The whole formula

Unit price = list price + tier surcharge + (under-minimum surcharge, if the quantity is below the SKU’s minimum). The price you see on the product page before you sign in is the walk-up price — the most anyone pays: no account, one box, below the minimum.

3.4 Currency, effective date and market references

All prices are in US dollars. The current price list is effective and may be revised at any time; the price that applies to your order is the one confirmed at checkout or in your quote, not the one you saw earlier.

Where a page shows a card’s market value, that figure is a Cardmarket European average converted from euros at a dated reference rate. It is context, not a US market price, and it is never an offer to buy or sell at that number.

4. Quotes and card checkout

There are two ways to buy, and the quantity decides which one you get. Below a SKU’s minimum you check out by card. At or above the minimum the order becomes a quote: we invoice it, because freight, duty and handling on a wholesale-volume shipment are billed at cost and cannot be known at the moment you press a button.

A quote is valid for 7 days from the date we send it, and is subject to stock remaining available. Quantities, prices and lead times in an expired quote lapse in full. Accepting a quote in writing forms the contract; payment terms are stated on the quote itself.

5. Order acceptance

An order placed through the site is an offer to buy, not a concluded contract. Neither the order confirmation screen nor the automatic email is an acceptance. The contract is formed when we confirm the order for shipment, or when we ship it, whichever happens first.

We may decline any order — including one already paid for — where stock has sold out, where a price or a listing was published in error, where we cannot verify the buyer, or where accepting it would breach an allocation obligation to our suppliers. Where we decline, we refund in full and promptly. That is the entire remedy for a declined order.

6. Shipping, title and risk

Delivery timing, freight, duty and handling, and our returns and damage policy are set out on Shipping & Returns, which forms part of these terms.

Title in the goods passes to you when we have received payment in full. Risk passes on delivery to you or your nominated address. Duty, import fees and any brokerage or handling charge are yours and are invoiced at cost — no price or promise on this site is a landed total.

7. Authenticity, condition and resale

Everything we sell is authentic Japanese-market product, sourced in Japan and verified before it ships. Product is sold factory sealed; we do not open, weigh, search or otherwise interfere with it, and we make no representation about the contents of any individual pack or box. Pull rates are set by the manufacturer.

You buy for resale and you resell in your own name, on your own terms, at your own prices. Nothing here appoints you an agent, distributor or franchisee of Tokyo Legends, and you may not describe yourself as one.

8. Intellectual property

Tokyo Legends is not affiliated with, endorsed by or sponsored by Nintendo, The Pokémon Company, Creatures Inc. or GAMES FREAK inc. Pokémon and all related names, logos and card designs are trademarks and copyrights of their respective owners. We sell genuine product manufactured by those owners; the trademarks are used only to identify what is in the box.

The site itself — its text, layout, photography, data compilations and code — is ours. Card images and card data are shown under the terms of the sources we take them from and remain the property of their respective owners.

9. Limitation of liability

Nothing in these terms excludes liability for fraud, for fraudulent misrepresentation, or for anything that cannot lawfully be excluded.

Subject to that: we are not liable for lost profits, lost sales, lost or spoiled resale opportunity, business interruption, or any indirect or consequential loss, however caused. Our total liability arising out of or in connection with any order is limited to the amount you paid for that order.

We give no warranty that any product will appreciate, hold value, or yield any particular pull. Sealed trading-card product is a speculative good and market prices move in both directions.

10. Governing law and disputes

Pending — for counselThe governing law of these terms and the forum for disputes have not been settled. This clause is deliberately blank rather than filled with a plausible default: choosing a jurisdiction is a legal decision with real consequences for both sides, and it will be drafted by our counsel and published here before it is relied on. Until then, nothing in this section waives any right either of us has by law.

11. Changes to these terms

We may revise these terms. The version that applies to your order is the one published when the order was accepted, and the “Last updated” date at the top of this page tells you which that was.
